Terms & Conditions

1.1. Acceptance of Terms
By accessing or using the Quick Care Connect platform (“Quick Care Connect”), you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree, you must not use the platform.

1.2. Platform Role
Quick Care Connect provides a technology platform that connects clients/patients, care providers, and healthcare agencies. Quick Care Connect does not provide healthcare services, employ care providers, or supervise medical care. All responsibility for care lies with the agency or provider.

1.3. Changes to Terms
Quick Care Connect reserves the right to update these terms at any time. Continued use of the platform after changes indicates acceptance of the revised terms.

1.4. User Eligibility
You must be at least 18 years old (or legally authorized by a guardian) to use Quick Care Connect. Additional eligibility criteria may apply to specific user roles.

1.5. Third-Party Services
Quick Care Connect uses Twilio, Mailgun, Intuit QuickBooks, and IProspectCheck. Use of the platform constitutes consent to their terms and conditions as-well-as share relevant data with these services under their respective privacy policies and BAAs.

1.6. HIPAA Compliance
Quick Care Connect implements industry-standard safeguards and maintains BAAs with key partners. However, care agencies and providers are responsible for their own HIPAA compliance obligations.


2. PATIENT/CLIENT TERMS

2.1. Account Creation
Patients may create profiles including personal, insurance, and health-related information. You are responsible for keeping your information accurate and up to date.

2.2. Care Requests
You may submit care requests, select preferences (e.g., insurance, availability), and review matched providers. Acceptance is not guaranteed.

2.3. Consent to Communication & Tracking
By using Quick Care Connect, you consent to:

  • Receiving phone, SMS, email, and push notifications.
  • GPS/IP tracking to verify appointments and improve matching.
  • Recording of VoIP calls and video sessions for safety and auditing.

2.4. Reviews
Patients and Provider may review one-another (post-appointment). Reviews must be honest, respectful, and non-defamatory.

2.5. Medical Emergencies
Quick Care Connect is not a substitute for emergency care. If you are experiencing a medical emergency, dial 911 immediately.


3. CARE PROVIDER TERMS (EMPLOYEES & CONTRACTORS)

3.1. Registration & Credentials
Care providers must complete a detailed registration process, which may include background checks, credential verification, and optional drug testing. Agencies determine requirements.

3.2. Independent Status
Unless explicitly hired by an agency, care providers are independent contractors. Quick Care Connect does not supervise or employ providers.

3.3. Conduct Standards
Providers agree to deliver care professionally, ethically, and in accordance with state licensure laws.

3.4. Tracking & Communication
You consent to GPS tracking, IP logging, and the recording of calls/messages with patients or agencies. This data is used for auditing, billing, and dispute resolution.

3.5. Payments
Payment terms are set by your affiliated agency. Quick Care Connect is not responsible for resolving payment disputes between providers and agencies.

3.6. Reviews & Ratings
You may receive and provide reviews. Abuse or manipulation of the review system is prohibited.


4. AGENCY / BUSINESS TERMS

4.1. Subscriptions & Billing
Agencies are billed via Stripe subscription. All fees are non-refundable unless legally required. Agencies are responsible for their own client billing.

4.2. Account Management
Agencies may create and manage provider and patient profiles within their portal. Agencies are responsible for verifying the qualifications and compliance of their team.

4.3. Branding & White Labeling
Agencies may use custom domains, logos, and colors as permitted. Agencies must ensure all content complies with applicable laws and platform rules.

4.4. Background & Drug Screening
Quick Care Connect facilitates access to IProspectCheck. It is the agency’s responsibility to determine whether to require such screening.

4.5. Communication Consent
Agencies agree to maintain 10DLC compliance and understand that all communication via the platform is logged and monitored for quality and legal purposes.

4.6. Liability & Indemnification
Agencies agree to indemnify Quick Care Connect for any claims arising from their providers, patients, or operations, including HIPAA breaches, misconduct, or service quality complaints.


5. LIMITATIONS OF LIABILITY & LEGAL TERMS

5.1. No Warranty
Quick Care Connect provides the platform “as-is” and disclaims all warranties, express or implied, including fitness for a particular purpose.

5.2. Limitation of Liability
Quick Care Connect’s total liability is limited to the subscription fees paid in the preceding 12 months. Quick Care Connect is not liable for indirect, incidental, or consequential damages.

5.3. Indemnification
Users agree to indemnify and hold harmless Quick Care Connect, its affiliates, and partners from any claim arising out of misuse of the platform, negligence, or violations of these terms.

5.4. Governing Law
These Terms shall be governed by U.S. federal law and the laws of the State of Florida.

5.5. State-Specific Notices

  • California: You have the right to cancel your subscription at any time. Quick Care Connect complies with Cal. Bus & Prof. Code §17602.
  • New York: Disclaimers of medical liability do not apply in cases of gross negligence.
  • Florida & Texas: Compliance with state-specific licensure requirements is the responsibility of providers and agencies.

5.6. Dispute Resolution
Any disputes will be subject to binding arbitration in the State of Florida, unless otherwise prohibited by law.
